Ex Parte is a latin term. It means, done with respect to or in the interest of one side due to non-appearance of the opposition.
As per our law, both the parties should be given equal opportunity to present them before passing any order.
However, in certain cases, courts may pass an ex parte decree (an official order given by a government). For instance, when after sending a few notices, one of the concerned persons did not appear before the court, then the order can be passed in his absence. In such cases, the order or the direction to proceed is said to be ex parte.
In a judicial proceeding, an order can be said to be ex parte when the decision has been taken or granted at the instance and for the benefit of one party only.
